Cura of Sweden AB, 559101-7610, ("CURA") was declared bankrupt on the 17th of January 2025, by decision of the Stockholm District Court. The District Court has appointed attorney Emma Berglund Uväng from Advokatfirman Schjødt as the bankruptcy trustee for the company.

INFORMATION FOR CUSTOMERS

General Information regarding product claims for purchases before bankruptcy

CURA is no longer able to process claims regarding products purchased before the bankruptcy declaration on 17 January 2025. Customers who wish to file a claim for products purchased before the bankruptcy may submit a claim for compensation according to the procedure described below. Consumers who made purchases using credit cards or other consumer credit facilities may be entitled to file a compensation claim with their credit provider. Consumers are furthermore referred to general consumer guidance services.

Returns of products for purchases before bankruptcy

CURA is no longer able to process returns for products purchased before the bankruptcy declaration on 17 January 2025. Customers who ordered products through CURA's e-commerce platform have a statutory right of withdrawal for fourteen days pursuant to the Act on Distance Contracts and Off-Premises Contracts (2005:59). Due to the bankruptcy proceedings, return claims cannot be enforced against either the bankrupt entity or the bankruptcy estate, except as a claim in the bankruptcy proceedings. For purchases made via credit card or other consumer credit facilities, compensation may be available from the credit provider. Customers are referred to general consumer guidance services. For orders placed after the bankruptcy declaration on 17 January 2025, the right of withdrawal may be exercised against the bankruptcy estate.

Claims and returns for products purchased after bankruptcy

Customers who wish to return or make claims for products purchased after the bankruptcy should contact customer service at support@curaofsweden.com. For purchases made after the bankruptcy, a two-week right of withdrawal applies against the bankruptcy estate according to the Act on Distance Contracts and Off-Premises Contracts. For detailed terms regarding the right of withdrawal, please see below.

  • Exchange rights: Exchange rights cannot be offered for products purchased either before or after the bankruptcy declaration.
  • Warranties: From the bankruptcy date of 17 January 2025, CURA can no longer offer any warranties for sold products. Claims based on warranties can be submitted to the bankruptcy estate according to the procedure described below.

GENERAL TERMS OF PURCHASE FOR PURCHASES AFTER THE BANKRUPTCY

These terms and conditions of purchase apply between you as a customer/buyer and CURA's bankruptcy estate (the "Bankruptcy Estate", "we" or "us"), when you purchase products via our website www.curaofsweden.com.

If you cannot find the answer to your question in these terms and conditions of purchase, please contact the Bankruptcy Estate using the contact information provided above.

These terms and conditions of purchase apply only to customers who are consumers.

When you place an order via our website, and we have confirmed the order, a purchase agreement is entered into between you and the Bankruptcy Estate. When your order has been confirmed, an order confirmation will be sent to the email address you provided.

To place an order and enter into an agreement with us, you must be at least 18 years of age.

These terms and conditions of purchase are accepted by the customer when the customer places an order via our website.

PRICES 

The prices on www.curaofsweden.com are stated including VAT. If otherwise applicable, this will be explicitly stated. Additional shipping costs may apply. The total price is displayed at checkout.

DISCOUNTED PRICES AND RETROSPECTIVE DISCOUNTS

Unfortunately, we are unable to apply price adjustments to previous orders once a new promotion has started.

PRODUCT CHARACTERISTICS

The product characteristics are specified on the specific product page. However, product images and other images on the website are considered illustrations and not exact descriptions of the products. The Bankruptcy Estate therefore reserves the right regarding any errors in stated prices, texts, and other content that inadvertently appear on the website. In the event the Bankruptcy Estate discovers inaccuracies in communicated information regarding your order, such as incorrect delivery time, stock value, or price information, you will be notified as soon as possible, whereupon you have the opportunity to modify or cancel your order. Thus, we reserve the right that products ordered by the customer based on incorrect information may be communicated as available when they are actually sold out. In such cases, the Bankruptcy Estate disclaims the obligation to procure ordered products from elsewhere.

PAYMENT

The website offers different payment options depending on which region you are shopping from. The options available for your specific purchase are therefore displayed at checkout and in the payment portal.

DELIVERIES

The shipping methods available for your purchase, the countries to which delivery can be made, delivery time, and additional information about delivery and shipping costs are shown at checkout.

We furthermore reserve the right to refuse certain deliveries to certain addresses, in cases where it is justified from a transport or logistics perspective.

Delivery notifications are primarily made via SMS and/or email.

The Bankruptcy Estate bears the risk of any product damage during delivery from the Bankruptcy Estate to the buyer. The risk transfers to the buyer when they take possession of the goods. If you

discover transport damage upon receipt of the goods, we ask you to notify us immediately, and if possible, secure evidence (i.e., take pictures of the damage).

In cooperation with transport companies, we do our best to ensure quick and efficient delivery. If you fail to appear and receive the goods you purchased despite agreement on time and place, you will be charged up to 249 kr for additional shipping and storage costs.

In the event of delayed delivery, we ask you to contact the Bankruptcy Estate. The primary principle is that the Bankruptcy Estate shall fulfill its part of the agreement and complete the delivery of the goods. Cancellation of the purchase can only be made if the Bankruptcy Estate has been given a reasonable additional time in connection with the complaint about the delay (unless the delay is of material significance). Contact information can be found at the beginning of these terms and conditions.

FURTHER REGARDING RIGHT OF WITHDRAWAL FOR PRODUCTS PURCHASED AFTER THE BANKRUPTCY DECLARATION

For purchases of products at a distance, for example from www.curaofsweden.com, the Act on Distance Contracts and Off-Premises Contracts is applied. This entitles customers to withdraw from their purchase within 14 days without stating any reason. The withdrawal period is calculated from the day after the buyer has received the goods (if the last day of the withdrawal period falls on a Saturday, Sunday, or public holiday, the buyer may withdraw from their purchase on the following business day as well).

If the buyer has purchased multiple items or an item consisting of multiple parts, the withdrawal period is calculated from the day the last item or the last part of the item is received. However, in cases of regular delivery of goods over a specified period, the withdrawal period is calculated from when the buyer receives the first delivery.

It is sufficient for the buyer to send notice of exercising the right of withdrawal before the withdrawal period expires.

For us to approve your return, the item must be unused and returned in unchanged condition, in its original packaging. If the product has been used during the withdrawal period and this has resulted in a reduction in value, the Bankruptcy Estate will make a deduction from the refund corresponding to the reduction in value. Unfortunately, we cannot determine the exact deduction until we have received and carefully evaluated the condition of the product.

Additionally, the Bankruptcy Estate offers a 14-day right of withdrawal if the packaging is unopened. The right of withdrawal for unopened packaging is exercised by using the Return Request form available at the following link curaofsweden.com/se/Reclaimit

REDUCTION IN THE VALUE OF THE RETURNED PRODUCT

As stated earlier: To be eligible for a return, the product needs to be unused, in its original condition (without signs of wear, damage or alteration) and in its original packaging. If the product has been used beyond what is necessary to establish its nature, characteristics or function, and this has led to a reduction in value, the Bankruptcy Estate may make a deduction from the refund corresponding to the reduced product value. This applies if the use exceeds what can reasonably be considered necessary during the withdrawal period, which is 14 days from the time your order was received.

We hope for your understanding in this respect, as we cannot resell products that have been opened and used. Unfortunately, we cannot determine the exact amount of the deduction for the refund until we have received the product and evaluated its condition.

FORCE MAJEURE

The Bankruptcy Estate is not obligated to fulfill agreements if extraordinary unpredictable events or circumstances beyond our control that reasonably could not have been prevented, such as (the following list is not exhaustive) fire, pandemic, flood, earthquake, hurricane, or other natural disaster, prevent the completion of purchase, delivery, or other obligations. The same applies if such circumstances significantly impede or delay the fulfillment of obligations, whereupon you as a consumer and the Bankruptcy Estate have the right to terminate the current purchase agreement.

INTELLECTUAL PROPERTY

All material on www.curaofsweden.com belongs to the Bankruptcy Estate or collaboration partners and may not be copied or otherwise used by third parties without written consent from the relevant rights holder. In cases where the products themselves are protected by intellectual property rights, the same aforementioned rules apply.

Swedish law applies to these terms and conditions.

DISPUTE RESOLUTION

Disputes arising from the application of these terms and conditions shall be settled by general courts. Consumers may also refer to the National Board for Consumer Disputes (Allmänna reklamationsnämnden) to have a dispute examined to the extent that the board is competent to examine the dispute. The National Board for Consumer Disputes' address is Box 174, 101 23 Stockholm, and the website address is www.arn.se. We participate in the dispute resolution process and follow ARN's recommendations. The European Commission also provides an online dispute resolution platform, specifically intended for consumers residing in other EU countries, according to the following link http://ec.europa.eu/consumers/odr. These alternative dispute resolution bodies are generally cheaper, less formal, and faster alternatives to court litigation.

If any provision in these terms and conditions of purchase should be deemed invalid, this shall not affect the validity of the other terms (provided that the absence of the invalid terms does not make the remaining provisions unreasonably burdensome for the consumer).

CURA's liability for damages is limited to a business operator's liability for damages according to mandatory consumer legislation in Sweden.
